Work Injuries & Workers Compensation

  1. If you have won your workers compensation case but have been sued into district court by your employer or insurance company, our office can help.  For years, we have represented injured workers in Judicial Review cases with extremely favorable results.
     
    Also, even though the employer or insurance carrier does not challenge your right to get benefits, they may challenge the amount of benefits that you are entitled to under law.  These challenges may be in claims for:
    Supplemental Income Benefits (SIBs)
    Lifetime Income Benefits (LIBs)

    Finally, in the worst of cases, the families of Texas workers who are killed at work may have several claims.  Initially, the family may be entitled to Death Benefits.  These benefits may provide income support for the spouse and children of a deceased worker for years.  Also, the Texas Constitution and Texas Labor Code may also provide the family of a deceased worker the right to sue his employer.  Our office can help the families of deceased workers to determine their rights and to make sure that the family is able to recover what they are entitled to under law.

Non-Subscriber Work Injury Claims
There are two common misconceptions about work injuries:

  1. The company has to pay for medical bills and lost wages if the employee is injured at work.  This is not true!  Although many states now require mandatory workers compensation, Texas does not.  An employer may be a “non-subscriber” under the Texas Workers Compensation Act.  If they are, the employer is not required by law to pay for anything related to the work injury incident.  For non-subscribers, the injured worker would be required to file a lawsuit for damages to make the employer pay fair compensation for his/her injuries.  Many non-subscriber employers carry private insurance plans which may look like Workers Comp. but may have exclusions which stop coverage if your bills get too high, if you cannot return to work by a certain time or if you are fired by the company.  Therefore, many injured workers believe that they will be taken care of by the company until they really need coverage, only to find that they are not protected.  Our offices specialize in protecting you and your family if you have been injured at work
  2. The company cannot fire anyone who is under a doctor’s care for work injuries.  The law requires only that the employer not terminate an employee because the employee files a workers compensation claim.  There is no protection under the law for termination in a non-subscriber work injury case.  Therefore, many people believe that their job is much safer than it is.  Because Texas is an “at will” employment state, there is no cause of action simply because you have been terminated.  Therefore, if you do not take action to make sure that your rights are protected when you are injured at work, you may find yourself hurt and unemployed.  Our offices specialize in making sure that you protect yourself and your family when you have been hurt in an accident.
